Heinrich von Kleist was intimately familiar with Prussia's controversial new legal code, the Allgemeines Landrecht für die Preußischen Staaten (ALR), and the debates it engendered. By reading Die Marquise von O… in light of the contemporary juridical discourse, this article offers new insight into the text and attempts to explain several textual oddities that have evaded a satisfying hermeneutic reading, including the parents’ opposing and often bewildering interactions with their daughter. By demonstrating the parents’ alignment with competing legal norms, this article reveals an overlooked contest in the text. Through this opposition, Kleist interrogates the ostensible superiority of the ALR and contemporary medico-legal notions about pregnancy and witnessing. This article further uncovers a surprising inversion: here, the mother judges her daughter according to the most up-to-date version of the law. This correspondence has critical implications for the role of women, the nature of the law, and how we read Kleist.
